Terms of Service

1. Your licence

We grant you a personal, non-transferable, non-exclusive licence to use StartSmart on Apple devices that you own or control, as permitted by the App Store Terms of Service. You may not copy, sell, sublicense, reverse-engineer or redistribute the app, except where that restriction is prohibited by law.

You must be at least 13 years old, and old enough to agree to these terms where you live.

2. Subscriptions, billing and cancellation

StartSmart requires an active subscription to use. There is no free tier.

The plans available to you, their prices in your local App Store storefront, and any free trial are shown in the App Store listing and in the app before you are charged. The price shown at the point of purchase is the price that applies.

• Auto-renewal. Payment is charged to your Apple Account at confirmation of purchase. Your subscription renews automatically at the same price and period unless you cancel at least 24 hours before the end of the current period. Your Apple Account is charged for renewal within 24 hours before the period ends.
• Free trial. Where a trial is offered, any unused portion is forfeited if you buy a subscription during the trial. If you do not cancel at least 24 hours before the trial ends, it converts to a paid subscription automatically.
• Cancelling. Manage or cancel your subscription in iOS Settings → your name → Subscriptions. Deleting the app does not cancel your subscription.
• Refunds are handled by Apple under the App Store Terms of Service. We cannot issue refunds for App Store purchases.

We may change prices or plans. A change to your existing subscription price takes effect only after the notice Apple requires, and you may cancel before it applies.

3. Alarms are not a guarantee

The app schedules alarms through Apple's AlarmKit, and whether an alarm sounds depends on things outside our control, including your device's power state, storage, volume and Focus settings, iOS behaviour and updates, and permissions you have granted or denied. We do not warrant that any alarm will sound at any particular time, and we are not liable for anything you miss.

4. AI-generated content

Wake-up messages are produced by a third-party AI model from the goal and preferences you provide. This content is generated automatically and is not reviewed by a person before you hear it. It may occasionally be inaccurate, inappropriate or not what you expected.

It is motivational content, not professional advice. It is not medical, psychological, legal or financial advice, and it is not a substitute for care from a qualified professional. If you are struggling with your mental health, please contact a professional or a local support service.

Subject to the App Store's own terms, we do not claim ownership of the goals you write or the scripts generated for you.

5. Imported audio and acceptable use

StartSmart lets you turn audio you already have — from a video in your photo library, or from a link you paste — into a personal alarm sound. When you do this:

• You confirm you have the right to use that audio in this way.
• The audio is for your own personal, non-commercial use as an alarm sound on your device only. You may not redistribute, publish or share it through StartSmart.
• You must comply with the terms of the service the content came from, and with applicable copyright law.

StartSmart is not a downloader: it imports a single item at your request, offers no browsing, searching or library of third-party content, and retains nothing on our servers.

You also agree not to use the app unlawfully, to interfere with it or the services it depends on, to attempt to access it by any means other than the interface we provide, or to use it to produce content that is unlawful or that harasses or harms another person.

6. Disclaimers and liability

The app is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose or non-infringement. We do not warrant that the app will be uninterrupted or error-free, or that any defect will be corrected.

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or opportunities, arising out of or relating to your use of the app. Our total liability for any claim relating to the app is limited to the amount you paid us for it in the twelve months before the claim arose.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. Where that is the case, the exclusions and limitations above apply only to the extent permitted, and nothing in these terms limits rights you have as a consumer that cannot be waived.

7. Termination

You may stop using StartSmart at any time by cancelling your subscription and deleting the app. We may suspend or end your access if you breach these terms or if we discontinue the app. Sections 3 through 6, and 9, survive termination.

8. Apple

This agreement is between you and Koviez LLC only, not with Apple, and Apple is not responsible for the app or its content. Apple has no obligation to provide maintenance or support for the app. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the app.

Apple is not responsible for addressing any claim by you or a third party relating to the app, including product liability claims, claims that the app fails to conform to a legal or regulatory requirement, and claims arising under consumer protection or similar legislation. Apple is not responsible for investigating, defending, settling or discharging any third-party claim that the app infringes intellectual property rights.

You represent that you are not located in a country subject to a US Government embargo or designated as a “terrorist supporting” country, and that you are not on any US Government list of prohibited or restricted parties.

Apple and Apple's subsidiaries are third-party beneficiaries of these terms, and upon your acceptance Apple will have the right to enforce them against you as a third-party beneficiary.

9. Changes, law and contact

We may update these terms. If a change is material, we will update the date at the top of this page and, where significant, notify you in the app. Continuing to use StartSmart after a change means you accept the updated terms.

These terms are governed by the laws of the State in which Koviez LLC is organised, and of the United States, without regard to conflict-of-law rules. The courts of that State have exclusive jurisdiction, except where mandatory local consumer law gives you the right to bring proceedings elsewhere.
